Terms of Service

Welcome to Diogo Cadavez. The terms "we", "us" and "our" refer to Diogo Cadavez. This store and website, including all related content, features, tools, products and services (the "Services"), is operated by Diogo Cadavez and powered by Shopify.

These Terms of Service ("Terms") describe your rights and responsibilities when using the Services. Please read them carefully — they include important information about your legal rights, warranty disclaimers, and limitations of liability.

By visiting, interacting with or using the Services, you agree to be bound by these Terms and our Privacy Policy [LINK]. If you do not agree, you should not use or access the Services.

Section 1 — Access and Account

By agreeing to these Terms, you confirm that you are at least the age of majority in your country of residence, and that you have given consent for any minor dependents to use the Services on devices you own or manage.

To use the Services you may be asked to provide information such as your email address, billing, payment and shipping details. You represent and warrant that all information you provide is correct, current and complete, and that you have all rights necessary to provide it.

You are solely responsible for maintaining the security of your account and for all activity that occurs under it. Accounts may not be transferred, sold, assigned or licensed to any other person.

Section 2 — Our Products

We have made every effort to represent our products accurately. However, colors and appearance may differ from how they display on your screen depending on your device and settings.

Products in this store fall into two categories:

Prints & Tote Bags are produced on demand by our print partner, Gelato. Each item is made specifically for your order. Slight color variation between screen and print is normal and not considered a defect.

Original Artworks are unique, one-of-a-kind pieces created and shipped directly by Diogo Cadavez. What you see is what exists — there is no second copy.

We do not warrant that the quality of any product will meet your expectations beyond what is described. Product descriptions are subject to change at any time. We reserve the right to discontinue any product at any time.

Section 3 — Orders

When you place an order, you are making an offer to purchase. Diogo Cadavez reserves the right to accept or decline any order at its discretion. Your order is not accepted until confirmed. Payment must be received and processed before acceptance.

Please review your order carefully before submitting — cancellation requests may not be possible once an order is accepted and production has begun.

If we do not accept, modify or cancel an order, we will notify you by email at the address provided at checkout.

Returns and exchanges are governed exclusively by our Refund Policy [LINK].

You confirm that purchases are for personal or household use only, not for commercial resale or export.

Section 4 — Prices and Billing

Prices are subject to change without notice. The price charged will be the price shown at the time your order is placed, confirmed in your order confirmation email.

Unless otherwise stated, posted prices do not include shipping or handling charges. VAT is included in product prices where applicable under Portuguese and EU law.

You agree to provide accurate and complete payment information and to keep it updated. You confirm that you are authorised to use the payment method provided and that charges will be honoured.

Section 5 — Shipping and Delivery

All delivery times are estimates only and are not guaranteed. We are not liable for delays caused by our print partner, shipping carriers, customs, or events outside our control.

Once an order is transferred to the carrier, risk of loss passes to you.

Section 6 — Intellectual Property

All content on the Services — including but not limited to artwork, images, text, graphics, designs, and poetry — is the original work of Diogo Cadavez and is protected by applicable copyright and intellectual property law.

These Terms permit you to use the Services for personal, non-commercial purposes only. You may not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store or transmit any material from the Services without prior written consent.

Purchasing a print or original artwork does not transfer any intellectual property or reproduction rights. The work remains the property of Diogo Cadavez. Any reproduction, resale or redistribution of artwork without written permission is strictly prohibited.

All rights not expressly granted are reserved.

Section 7 — Optional Tools

You may be provided with access to tools offered by third parties as part of the Services. We neither monitor nor control these tools and provide access to them "as is" without warranties or endorsement. We are not liable for any loss or damage arising from your use of optional third-party tools.

Section 8 — Third-Party Links

The Services may contain links to third-party websites. We are not responsible for the content, accuracy or practices of any third-party site. Accessing third-party sites is at your own risk. Any complaints or claims regarding third-party products or services should be directed to that third party.

Section 9 — Relationship with Shopify

Diogo Cadavez is powered by Shopify. However, all sales and purchases are made directly with Diogo Cadavez. Shopify is not responsible for any aspect of transactions between you and Diogo Cadavez, including any injury, damage or loss resulting from purchased products. You expressly release Shopify and its affiliates from all claims arising from your transactions with Diogo Cadavez.

Section 10 — Privacy Policy

All personal information collected through the Services is subject to our Privacy Policy [LINK]. By using the Services, you confirm you have read and understood it. Because the Services are hosted by Shopify, Shopify also collects and processes certain information about your use of the Services in accordance with their own privacy policy.

Section 11 — Feedback

By submitting feedback, reviews, suggestions or similar content, you grant Diogo Cadavez a perpetual, worldwide, royalty-free licence to use, reproduce, modify and distribute that content for any purpose related to operating and improving the Services.

You confirm that you own or have the rights to any feedback submitted, and that it does not violate any third-party rights. We are under no obligation to keep feedback confidential, compensate you for it, or respond to it.

Section 12 — Errors, Inaccuracies and Omissions

We reserve the right to correct any errors, inaccuracies or omissions in product descriptions, pricing, availability or other information at any time without prior notice, including after an order has been submitted.

Section 13 — Prohibited Uses

You may only use the Services for lawful purposes. You may not use the Services to violate any applicable law; infringe on intellectual property rights; harass, harm or impersonate any person; transmit false or misleading information; send unsolicited communications; upload malicious code; scrape or extract data; or otherwise interfere with the operation or security of the Services.

We reserve the right to suspend or terminate access to the Services at any time if we determine these Terms have been violated.

Section 14 — Agents

This section applies if you use or enable any automated software or service ("Agent") to access or interact with the Services. Agents must identify themselves in all requests and may not mimic human behaviour, circumvent security measures, or conceal that interactions are automated. We may limit or block Agent access at any time.

Section 15 — Termination

We may terminate this agreement or your access to the Services at any time without notice. You remain liable for all amounts due up to the date of termination. Sections covering Intellectual Property, Feedback, Disclaimers, Limitation of Liability, Indemnification, and Governing Law survive termination.

Section 16 — Disclaimer of Warranties

THE SERVICES AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE.

Section 17 — Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, DIOGO CADAVEZ, ITS PARTNERS, AFFILIATES, AGENTS AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCTS PURCHASED THROUGH THEM, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST DATA OR REPLACEMENT COSTS.

Section 18 — Indemnification

You agree to indemnify and hold harmless Diogo Cadavez, Shopify, and their affiliates and service providers from any claims, losses or liabilities — including reasonable legal fees — arising from your breach of these Terms, your violation of any law, or your use of the Services.

Section 19 — Severability

If any provision of these Terms is found to be unlawful or unenforceable, that provision will be limited to the minimum extent necessary and the remaining Terms will continue in full force.

Section 20 — Waiver; Entire Agreement

Failure to enforce any provision of these Terms does not constitute a waiver. These Terms, together with our Privacy Policy, Shipping Policy and Refund Policy, constitute the entire agreement between you and Diogo Cadavez regarding use of the Services.

Section 21 — Assignment

You may not transfer or assign these Terms or any rights under them without our prior written consent. We may transfer or assign our rights without notice.

Section 22 — Governing Law

These Terms are governed by and construed in accordance with the laws of Portugal and applicable European Union law. Any disputes arising from these Terms or your use of the Services shall be subject to the jurisdiction of the courts of Bragança, Portugal, without prejudice to any mandatory consumer protection rights you may have under the law of your country of residence within the EU.

Section 23 — Changes to Terms of Service

We reserve the right to update or replace these Terms at any time. Material changes will be communicated in accordance with applicable law. Your continued use of the Services after any changes constitutes acceptance of the revised Terms. The current version is always available on this page.
